مهنة الصحافة في ليبيا.. لا تتحدث عن السياسة

لم يخطر على بال الصحفي إسماعيل بوزريبة حين اقتنى كاميرته وباقي أدوات عمله؛ أن ينتهي به المطاف في السجن، وبعقوبة قاسية وجائرة تصدر في العادة بحق القتلة ومرتكبي الجرائم البشعة.

15 سنة سجنا هو الحكم الذي تلقاه بوزريبة بعدما احتجزته السلطات في شرقي ليبيا لأكثر من 20 شهرا بتهم مختلفة، من بينها التآمر والعمل مع قنوات معادية للجيش!

 

تكميم الأفواه

رغم أن الحكم صدر من محكمة بنغازي العسكرية منذ مايو/أيار الماضي، فإن أهل بوزريبة ومحاميه لم يعلموا به إلا بعد قرابة ثلاثة أشهر من صدوره، كما لم يُخطَر محاميه بعرضه على النيابة من عدمه طيلة فترة اعتقاله، وكذلك لم يتم إخطاره بموعد جلسة الحكم، على نحو يشكك في سلامة الإجراءات وجدية المحاكمة وعدالتها.

بوزريبة اعتقله عناصر الشرطة عندما كان يغطي فعالية ثقافية في مدينة أجدابيا (160 كلم غرب بنغازي) في ديسمبر/كانون الأول 2018.

وبحسب مصادر من الشرطة فإنه عُثر في هاتفه على رسائل نصية وتدوينات رأي تنتقد قيادة الجيش في الشرق وعملية "الكرامة" العسكرية.

الأسلوب ليس جديدا على السلطات في الشرق، وهذا لا يستثني وجود خروقات في الغرب الليبي، فعملية التضييق على الصحفيين باتت واضحة للعيان. سياسة الفرد الواحد والرأي الواحد لا تناسبها حرية الصحافة والتعبير، غير أن هذا الحكم يعد الأول من نوعه من حيث عدد السنوات وأسلوب المحاكمة، وهو ما يطرح تساؤلا: هل مثل هذه الأحكام على الصحفيين وأمام قضاء عسكري لا مدني، غرضه حماية الحرية والأمن العام كما تسوّق له السلطة، أم حماية الخائفين من هذه الحريات؟ 

الحكم أثار موجة من الاستنكار المحلي والدولي، كان في مقدمتها بعثتا الأمم المتحدة والاتحاد الأوروبي في ليبيا وعدد من المنظمات الحقوقية والصحفية، حيث عبرت كل هذه المنظمات عن استيائها وقلقها من مثل هذه الأحكام في حق الصحفيين، لما تنطوي عليه من انتهاك للقوانين الدولية وتكميم للأفواه بمصادرة حرية الرأي والتعبير. 

 

رسالة مؤلمة

هذا التخوف لمستُه فعلا حين تحاشى الكثير من الصحفيين في المنطقة الشرقية الحديث معي بخصوص قضية بوزريبة وتأثيرها على عملهم، أفضلهم حالا تحدث بحذر واقتضاب، كما طلب مني عدم ذكر اسمه أو حتى الإشارة إليه، خوفا من التعرف على هويته ومن اعتقاله.

صحيفة "واشنطن بوست" الأميركية نشرت تقريرا عن الحكم الذي تعرّض له الصحفي بوزريبة، ونقلت عن محامين ليبيين قولهم إن هذا الحكم بعث برسالة تقشعر لها الأبدان، حيث يتعرّض الصحفيون لعدد من المخاطر أثناء التنقل في مناطق الشرق التي يسيطر عليها اللواء المتقاعد خليفة حفتر الذي يسعى للقضاء على جميع معارضيه، بحسب الصحيفة.

وتحدثت الصحيفة أن هناك تعديلات قانونية أُقرت قبل ثلاثة أعوام في شرقي ليبيا لتتمكّن المحاكم العسكرية -على نطاق واسع- من محاكمة أي شخص يُشتبه في دعمه لما تسميه الإرهاب، مشيرة إلى أن هناك عشرات الهجمات على المراسلين بهذه الذرائع الواهية من قبل قوات حفتر التي تحظر جميع الصحفيين غير الموالين لها.

 

تطويع مكافحة الإرهاب

لقد حذرت منظمات عدة من هذا الوضع حين قالت إن سلطات الشرق الليبي تستغل قضية مكافحة الإرهاب -التي باتت غاية مشروعة- في تكميم الأفواه ومصادرة الحقوق والحريات العامة التي كفلها الدستور والاتفاقيات الدولية الملزمة للدولة الليبية.

"غياب الآلية في اتهام الصحفيين تثير الرعب لدينا.. كان يجدر بهم مخاطبة نقابة الصحفيين بوجود مخالفات -هذا إن وجدت- لا أن يتم اعتقاله بشكل تعسفي ودون إخطار ذويه ولا محاميه، وتطويع وتمييع قانون مكافحة الإرهاب بما يناسبهم. والأسوأ من كل ذلك هو عرضه على محكمة عسكرية بأسلوب ترهيب له ورسالة لغيره من الصحفيين. الصحفي له الحق في تناول بعض المواضيع الحساسة فهذا يقع ضمن مجال عمله، لكن لا يجوز أخلاقيا ولا قانونيا استخدام أسلوب كهذا معه، طالما لم يثبت تورطه في أي أعمال عنف أو تحريض على حمل السلاح"، بحسب ما قاله أحد الصحفيين من مدينة بنغازي مفضلا عدم كشف هويته لدواعٍ أمنية. 

الصحفي قد يرتكب بعض الأخطاء، لكن حينها يجب اتخاذ الخطوات الصحيحة معه ومخاطبة الجهات المعنية لرصد هذه التجاوزات، فحرية التعبير مبدأ أساسي يجب عدم التخلي عنه تحت ضغوط التخويف وتكميم الأفواه والخطوط الحمراء أو تحت وطأة قانون مكافحة الإرهاب، فكشف الحقائق وإظهارها من صلب عمل الصحفي، ويجب عدم منعه من ذلك.

قانون مكافحة الإرهاب يستخدم تعريفًا واسعًا لغاية العمل الإرهابي، ويتضمن نصوصا وأحكاما قانونية غامضة تُستخدم لتقييد حرية التعبير والحق في التجمع السلمي وتكوين الجمعيات، إذ يضع هذا القانون قيودًا عديدة على حرية التعبير، ويفرض الرقابة على المواقع الإلكترونية بصورة تجعل ممارسة التدوين أو التعبير الحر محفوفة دائمًا بمخاطر السجن لفترات طويلة، على نحو يكشف غايته الحقيقية في خنق ومصادرة كل أشكال المعارضة السياسية السلمية، وكل الأصوات المستقلة، وهو ما جعل ليبيا تأتي في المرتبة 164 من بين 180 دولة في التصنيف العالمي لحرية الصحافة لعام 2020، الذي تصدره منظمة "صحفيون بلا حدود".

 

اعتزال المهنة

لقد أجبر هذا الوضع عددا من الصحفيين على ترك المهنة، وبعضهم غادر البلاد من الأساس، خصوصا بعد الحرب التي شنها اللواء حفتر على العاصمة طرابلس في أبريل/نيسان 2019، والتي فاقمت الوضع الهش للصحفيين الذين يتعرضون للمضايقات والاحتجاز التعسفي والتهديد بمجرد إبداء رأيهم في هذه الحرب. 

يقول ذات الصحفي من بنغازي "لم يعد هناك مجال للإبداع أو العمل، إما أن تكون ضمن جوقة المطبّلين لمن يسيطرون على المشهد، أو عليك أن تتلقى كل التهم والصفات التي لم تخطر لك على بال، فعقوبة السجن في قضايا النشر، وسلطاتهم غير المحدودة في القبض وتفتيش كافة مقتنياتك من هاتف وجهاز حاسوب، أصبحت كحبل المشنقة الذي يلف على أعناق الصحفيين المستقلين". 

لا أحد يمكنه نكران أن الفترة الحالية هي أسوأ الفترات التي مرت على الصحفي الليبي في التاريخ الحديث، فبسبب الانقسام السياسي وانتشار السلاح، شُنّت على الصحفيين حملات تشويه على وسائل التواصل الاجتماعي، فقط لأنهم اختلفوا في الرأي مع تيار أو مجموعة ما. وهناك صحفيون اضطروا -كما أشرنا- لمغادرة البلاد بسبب تلك الحملات، أو بسبب اختطافهم أو تهديدهم بذلك. 

 

تاريخ من القمع

ربما يرى البعض أن الوضع الحالي استكمال للمشهد المظلم السابق إبان حكم العقيد الراحل معمر القذافي، فوسائل الإعلام الرسمية في ذلك الوقت كانت خاضعةً لسيطرة مؤسسات مختلفة تبعًا لمزاج النظام واستعداده لإرخاء قبضته أو تشديدها.

في العام 1971، وُضِعَت وسائل الإعلام الحكومية تحت مظلة وزارة الإعلام. وفي العام التالي، صدر قانون الصحافة الذي يحدّد بالتفصيل القيود الحكومية على وسائل الإعلام والعقوبات المفروضة بسبب التجاوزات. أقرّ القانون معاقبة مَن "يشوّهون سمعة البلاد" بالسجن المؤبّد، وفرض عقوبة الإعدام على كلّ من يتجرّأ على الدفاع داخل ليبيا عن "نظريات أو مبادئ تهدف إلى تغيير المبادئ الأساسية"..

وسرعان ما نُفّذ هذا الأمر عام 1979، حيث تم الحكم بالسجن المؤبد على أكثر من عشرة صحفيين جملة واحدة دون أي تفاوت في الأحكام، فيما عُرف آنذاك "بقضية الصحافة". واستمر التضييق على الصحفيين أغلب سنوات حكم القذافي، ولعل الحدث الأبرز هو قتل الصحفي ضيف الغزال عام 2005 بعد انتقاده قضايا فساد في البلاد، رغم أنه لم يأت على ذكر القذافي، حيث عُثر على جثته متحللة، وكشف الطب الشرعي تعرّضه لعملية تعذيب بشعة قُطعت فيها أصابعه وطُعن بالسكين قبل أن يُجهَز عليه بالرصاص.

 

تسييس واصطفاف

يشير الكاتب والمدون الليبي المقيم في بريطانيا فرج فركاش إلى أنه رغم الاستبشار بالمناخ الذي أتيح للصحفيين بعد انتهاء النظام السابق عبر تعدد وسائل الإعلام، حتى كانت هناك فرصة لها للعمل كسلطة رابعة، فإن غياب ميثاق شرف وقوانين منظمة للإعلام، وتسييس الإعلام والاصطفاف الأعمى وغياب الرقابة والمصداقية، إضافة إلى غياب تقبل الرأي والرأي الآخر، كل ذلك تسبب في تراجع مؤشر حرية الصحافة بليبيا إلى رقم مخيف، فالاعتداءات والاعتقالات استمرت ولم تتوقف، وآخرها كان الحكم بالسجن 15 عاما على الصحفي بوزريبة وأمام محكمة عسكرية، في سابقة خطيرة تهدف إلى إسكات أي صوت معارض.

"للأسف، الحرية الصحفية أصبحت الآن متاحة حسب التوجه، وتتمثل في حرية مهاجمة الخصوم في منطقة سيطرة أعدائهم، حتى بالافتراءات وترويج المغالطات المفعمة بخطاب الكراهية التي زادت مع حملة حفتر العسكرية الفاشلة على طرابلس.. ورأينا عودة القمع في بعض المناطق بشكل ملحوظ وصل حدَّ التهديد العلني للمدونين والصحفيين والإعلاميين، وعلى قنوات ممولة حكوميا.. مما اضطر بعضهم للتوقف عن الكتابة، أو الهجرة إلى مناطق أخرى في ليبيا أو إلى خارج البلاد"، بحسب ما ذكره فركاش.

 

المراهنة على الوقت

ما يخشاه فعلا الصحفيون في ليبيا هو مراهنة المتورطين والضالعين في هذه الجرائم على الوقت والنسيان، فهم لم يردّوا -ولو باقتضاب- على خطابات الاستنكار والإدانة الصادرة عن المنظمات والدول.. وكسب رهان الوقت سبق أن نجح فيه هؤلاء، فما الذي سيجعل الصحفي بوزريبة استثناء؟  

على العموم، لا يمكن الحديث عن معالجة هذه الظاهرة المستفحلة قبل توحيد البلاد سياسيا وإنهاء حالة الاستقطاب. وحتى ذلك الحين، ستبقى حرية الإعلام مجرد أمل منشود تحتاج إلى قوانين لحمايتها ولتحديد حقوقها وواجباتها. أما الأسلوب الأمني القمعي في مواجهة الإعلام فهو مجرد محاولة بائسة أثبت التجارب السابقة فشلها.
